I have a contract with a single member LLC with his SSN for tax purposes. When we pay him we pay to him individually not his LLC cause he filled out his W-9 in his individual name and SSN. Should I create a new contract in his individual name or is it ok to leave it under his LLC name?
I would either send him payments under his llc name or have him sign a personal contract.

He should have filled out paperwork supplying his EIN#. If you have an LLC you should have an EIN number that you use for conducting business, you are not supposed to use your social security number when doing business and getting paid under your LLC. Leave the contract as is but have him fill out the W9 supplying his EIN number.
